Do I have to worry about a covenant marriage divorce in Maryland?

On Behalf of | May 29, 2024 | Divorce |

A covenant marriage is a distinct legal arrangement recognized in some states, and it has become a hot topic as the current speaker of the House of Representatives was married under this framework. In this type of marriage, couples agree to pre-marital counseling and accept more limited grounds for divorce. The aim is to strengthen marriages and reduce divorce rates by emphasizing marriage as a respected institution.

Covenant marriage recognition in Maryland

Contrary to some states, Maryland does not acknowledge covenant marriages. Indeed, it is only recognized in including Arizona, Arkansas and Louisiana. Couples in Maryland cannot enter into a covenant marriage under the state’s laws. This absence means that the requirements and limitations associated with covenant marriages do not apply within Maryland.

Covenant marriage versus traditional marriage

In a traditional marriage, couples are not obligated to undergo pre-marital counseling or accept restricted grounds for divorce. However, covenant marriages demand pre-marital counseling and limit the reasons for divorce. Given Maryland’s stance, these distinctions are not relevant within the state’s legal framework. Nonetheless, there is nothing stopping couples from undergoing pre-marital counseling on their own and outlining duties and consequences for actions in a prenuptial agreement.

Divorce process in Maryland

Despite Maryland’s non-recognition of covenant marriages, understanding the divorce process in the state remains essential. To initiate a divorce in Maryland, specific forms must be completed and filed with the circuit court in the relevant county. Grounds for divorce in Maryland include one-year separation, mutual consent, adultery, desertion, cruelty, insanity and incarceration.

Residents of Maryland planning to divorce need not concern themselves with covenant marriage implications. Maryland’s legal landscape does not recognize covenant marriages, eliminating any worry regarding specific requirements or limitations associated with them. Though, a comprehensive understanding of Maryland’s divorce process is crucial for those contemplating marital dissolution.
